بررسی و نقد دیدگاه جودیث جارویس تامسون در دفاع از سقط جنین

چکیده

امروزه در مباحث اخلاقی راجع به سقط جنین سه دیدگاه کلی وجود دارد: مخالفت با سقط جنین جز در شرایط اضطراری؛ موافقت مطلق، و سوم، دیدگاه میانه یا موافقت مشروط. یکی از رهیافت‌های مهم در میان مدافعان مطلق یا مشروط سقط جنین، رهیافت مبتنی بر حق زن بر بدن خود است. در این رهیافت مهم‌ترین و تأثیر‌گذارترین استدلال از آن جودیث تامسون، در مقاله معروف "دفاع از سقط جنین" است. تامسون در اثبات مدعای خویش مبنی بر اینکه دست کم در برخی موارد، مثل تجاوز به عنف، سقط جنین از حیث اخلاقی جایز است به ارائه استدلال مستقلی نمی‌پردازد، بلکه با استفاده از حق مادر بر تن خود، به تضعیف استدلال طرفداران مخالفت مطلق با سقط جنین می‌پردازد. یکی از مهم‌ترین نقدهای صورت گرفته بر استدلال تامسون از آن فرانسیس بکویث است. اشکالات مطرح شده از سوی بکویث ذیل سه عنوان کلی حقوقی، ایدئولوژیکی، و فلسفی آمده است. موضوع مقاله پیش رو، بررسی و نقد استدلال تامسون و نقدهای وارد شده بر آن خصوصاً نقدهای فلسفی مطرح‌شده از سوی بکویث است.

Nowadays, there are three main viewpoints on abortion in ethical controversies:  opposition to abortion except for emergency situations, absolute agreement, and moderate viewpoint or conditional agreement. One of the important approaches among absolute or conditional defenders of abortion is the one which is based on the right of the woman to his body; in this approach the most important and influential reasoning is of Judith Thomson in his famous article "Defending Abortion". 
Thomson does not use a separate reasoning to prove his claim, saying at least in some cases like rape, abortion is morally permissible, but uses the right of the mother to his body to weaken the absolute opponents' reasoning about abortion. One of the most important criticisms of abortion is of Francis Beckwith. Problems which are presented by Beckwith are categorized under three main titles; "legal", "ideological", "philosophic". The subject of this article is the analysis of Thomson's reasoning and the criticisms of it, especially philosophic criticisms presented by Beckwith.
