And the philosophy of law is concerned with providing a general philosophical analysis of law and legal institutions. In the philosophy of law, two discussions may be more important. One is the basis of law and the other, its goals. So on one hand, there is a disagreement between scholars of law on whether the basis of law is revelation, reason or experience, and on the other hand, on whether the aim of law is individual-based or society-based or a synthesis of these two. Such a disagreement can practically cause different effects. Consequently, the contrasting effects can be seen in the philosophy of environmental law as well. Here, in theists’ view, protection of environmental law is due to the motivation of fulfilling a religious obligation, whereas in materialists’ opinion it is motivated by profiteering. Thus, a fundamental work prior to any discussions on the complex issues of environmental law is debate on the philosophy of environmental law and its dualistic effects, which the present paper attempts to deal with. <br />  مقاله‌ای‌ که‌ در پیش‌ رو است‌ به‌ بحث‌ از فلسفه‌ حقوق محیط‌ زیست‌ و آثار آن ‌می‌پردازد. و مراد از فلسفه‌ حقوق، نظریه‌ کلی‌ حاکم‌ بر علم‌ حقوق است‌ که‌ گاهی‌ به‌ آن‌ کلیات‌ حقوق هم‌ گفته‌ می‌شوند که‌ موضوع‌ آن‌ بحث‌ از رابطه‌ منطقی‌ بین‌ قواعد موجود است‌، اما دو امر مهم‌ در فلسفه‌ حقوق دخیل‌ است‌ که‌ یکی‌ مبنای‌ حقوق و دیگری ‌هدف‌ آن‌ است‌. از نظر مبنای‌ حقوق در این‌ که‌ آیا مبنای‌ حقوق وحی‌ یا عقل‌ بشر یاتجربه‌ و مشاهده‌ یا لذت‌ و غیره‌ است‌، بین‌ دانایان‌ فن‌، اختلاف‌ است‌ و در این‌ که‌ آیا هدف‌ حقوق که‌ بیشتر جنبه‌ سیاسی‌ دارد آیا اصالت‌ فرد است‌ یا اجتماع‌ و دولت‌ یا تلفیقی‌ از این‌ دو، باز اختلاف‌ است‌ و این اختلاف‌ در عمل‌، نتایج‌ متفاوتی‌ را به‌جا می‌گذارد. که‌ یکی‌ از آن‌ موارد، بحث‌ از فلسفه‌ حقوق محیط‌ زیست‌ است‌ و بسته‌ به‌ این‌ که‌ فلسفه‌ حقوق محیط‌ زیست‌، نگرش‌ مادی‌ یا الهی‌ باشد، نتایج‌ دوگانه‌ای‌ را به‌دنبال‌ دارد. بنابراین‌ بحث‌ از فلسفه‌ حقوق محیط‌ زیست‌، یک‌ بحث‌ مبنایی‌ است‌ که‌ لازم‌ است‌ قبل‌ از مباحث‌ طولانی‌ حقوق محیط‌ زیست‌ به‌ آن‌ پرداخته‌ شود.<br />به‌ طور خلاصه‌ می‌توان‌ گفت‌: فلسفة‌ دفاع‌ از حقوق محیط‌ زیست‌، نزد الهیون‌، عمل‌ به‌ تکلیف‌ در حفظ‌ محیط‌ اطراف‌ است‌ در حالی‌ که‌ این‌ فلسفه‌ نزد افراد مادی‌، سودجویی‌ بیشتر است‌ و اگر از حقوق محیط‌ زیست‌ نیز سخن‌ می‌گویند به‌خاطر این ‌است‌ که‌ در بلندمدت‌ از سود فراوان‌تری‌ برخوردار باشند و بدیهی‌ است‌ که‌ اختلاف‌ در نگرش‌ فلسفی‌، آثار مختلفی‌ نیز به‌دنبال‌ خواهد داشت‌.<br />  https://pfk.qom.ac.ir/article_261_a05e6595fe4ccb6f5ac017de6e29e636.pdf
