class="hps">several</span> <span class="hps">parties</span><span>.</span> <span class="hps">Rational</span> <span class="hps">are</span> <span class="hps">male relative</span> <span class="hps">of life</span> <span class="hps">that</span> <span class="hps">are</span> <span class="hps">attributable to the</span> <span class="hps">father</span><span>,</span> <span class="hps">releasing</span> <span class="hps">Johnny</span><span>,</span> <span class="hps">Jryrh</span> <span class="hps">and</span> <span class="hps">his</span> <span class="hps">sponsor</span><span>.</span> <span class="hps">This article</span> <span class="hps">has two parts</span><span>:<span title="در بخش اول نویسنده ابتدا عاقله را از نظر لغت‌شناسان و فقها تعریف کرده آنگاه اجماع فقهای اسلام و روایات رسیده از ائمه علیهم‌السلام در اثبات عاقله را مورد بررسی قرار داده است.">In the first part the author first to philologists and scholars have defined the rational consensus of Muslim scholars and wise sayings from the Imams peace be upon them prove to be examined. </span><span title="سپس به کیفیت تقسیط دیه بر افراد عاقله پرداخته و با بیان نظرت مختلف، به این نتیجه رسیده که حکم عاقله، حکم حکومتی است و لذا تقسیط دیه به عهده حاکم شرع است تا اختلافی بوجود نیاید.">Then split the money on quality and rational people expressed different opinion, to the conclusion that the rational judgment, ruling the state and therefore the judge's split the difference happens to the money. </span><span title="نویسنده در بخش دوم ابتدا به فلسفه تشریع این حکم پرداخته و نتیجه گرفته که عاقله پیمان شرعی و اختیاری، به منظور حمایت از خانواده است.">The author of the second part of the first sentence and concluded that rational philosophy legislation and voluntary legal treaty, in order to support the family. </span><span title="سپس به اشکالات مخالفان پاسخ داده و به این نتیجه رسیده که این حکم از احکام مترقی اسلام است.">The opposition responded to the problems and come to the conclusion that the provisions
